Important update regarding Indian Standard applicable to all existing Licence holders/ New applicants/ manufacturers/ importers/ product sellers for Gamma Picoline.
The Ministry of Chemicals and Fertilizers, through its Department of Chemicals and Petrochemicals, issued the Gamma Picoline (Quality Control) Order, 2020. Following several amendments, the implementation date has been extended from February 5, 2021, to13th March 2024.
This order has been established under the Bureau of Indian Standards Act, 2016, with the objective of ensuring the quality and safety of Gamma Picoline, serving the public interest through strict adherence to established standards.
Key Provisions of the Gamma Picoline (Quality Control) Order, 2020
1. Title, Application, and Effective Date
This order is formally titled the Gamma Picoline (Quality Control) Order, 2020, and includes the following provisions:
- The order was originally set to be enforced 181 days following its publication in the Official Gazette.
- However, due to amendments, the enforcement date is now extended to 13th March 2024.
- The order is applicable to all Gamma Picoline products, with an exemption for goods or articles specifically manufactured for export.
2. Conformity to Standards and Compulsory Use of the Standard Mark
Gamma Picoline must conform to Indian Standard IS 16113:2013 and carry the BIS Standard Mark (ISI Mark) to validate compliance:
- Manufacturers must secure a valid license from the Bureau of Indian Standards (BIS) under Scheme-I of Schedule-II of the BIS (Conformity Assessment) Regulations, 2018. This certification confirms that Gamma Picoline products meet all required standards.
- The mandatory use of the Standard Mark applies to domestic products, while those intended for export must only comply with the destination country’s requirements.
3. Certification and Enforcement Authority
The Bureau of Indian Standards (BIS) is designated as the certifying and enforcement authority for Gamma Picoline under this order. BIS is responsible for ensuring compliance with the specified standards and maintaining the integrity of the Indian market.
4. Penalties for Non-Compliance
Any person found in violation of the Gamma Picoline (Quality Control) Order, 2020, shall face penalties as outlined in the Bureau of Indian Standards Act, 2016. These penalties serve to enforce compliance and maintain quality assurance.
This order represents a significant regulatory step in upholding the quality of Gamma Picoline products, promoting safety and consistency for consumers and industry stakeholders.
