Extension of Timeline for Filing Quarterly and Annual Returns for E-Waste

Image

In a move aimed at easing compliance for registered entities, the Ministry of Environment, Forest and Climate Change (MoEFCC) has announced an extension for filing quarterly and annual returns under the E-Waste (Management) Rules, 2022. The order, issued on 12 November 2024, provides clarity and relief to stakeholders navigating these regulations.

Key Highlights of the Order

  1. New Deadline:
Registered entities on the E-Waste EPR Portal now have until 31 December 2024 to submit their quarterly and annual returns for the financial year 2023-24.

  2. Reason for Extension:

The Central Pollution Control Board (CPCB) received requests from industry associations citing the need for additional time to comply with filing requirements.

CPCB formally requested the Ministry to extend the deadline from the earlier date of 31 August 2024.

  1. EPR Certificate Operations:
During the extended period, activities related to Extended Producer Responsibility (EPR) Certificate generation and transfer will continue to be operational on the EPR portal.

Why This Extension Matters

For Registered Entities:

  Flexibility:
The extension allows industries more time to organize and file accurate returns, ensuring compliance without undue pressure.

  EPR Compliance:
Businesses can continue managing their EPR obligations seamlessly during this extended timeline, maintaining the flow of responsibilities like certificate generation and transfer.

For the Environment:

  Streamlined Reporting:
The extension ensures entities can adhere to the rules properly, supporting better e-waste tracking and management.

  Encouraging Compliance:
Providing additional time reflects the Ministry’s supportive stance in ensuring environmental goals are met without creating bottlenecks for stakeholders.

Official Reference

The Ministry extended the timeline under the provisions of Rule 9A of the E-Waste (Management) Amendment Rules, 2024. This decision underscores the government's balanced approach to environmental regulation and industrial feasibility.

What Should You Do Next?

  1. Mark Your Calendar:
Ensure all quarterly and annual returns for FY 2023-24 are submitted by 31 December 2024.

  2. EPR Portal Usage:
Continue utilizing the EPR portal for certificate generation and transfer during this period.

  3. Avoid Last-Minute Rush:
Use the extended time wisely to avoid errors or delays in submissions.

Final Thoughts

The government’s decision to extend the filing timeline is a welcome move for businesses and the environment alike. By providing this additional time, the Ministry demonstrates its commitment to fostering compliance while ensuring effective implementation of the E-Waste (Management) Rules, 2022.
