Important update regarding Indian Standard applicable to all existing Licence holders/ New applicants/ manufacturers/ importers/ product sellers for Phosphorous Oxychloride.

BIS QCO for Phosphorous Oxychloride

The Ministry of Chemicals and Fertilizers, through its Department of Chemicals and Petrochemicals, issued the Phosphorus Oxychloride (Quality Control) Order, 2020 on June 16, 2020. This Order is enacted under the authority of the Bureau of Indian Standards Act, 2016, to ensure the quality and safety of Phosphorus Pentachloride in the public interest. 

1. Short title, commencement, and application

1.1. This Order may be called the Phosphorus Oxychloride (Quality Control) Order, 2020.
1.2. It shall come into force on the one hundred and eighty-first day from the date of its publication in the Official Gazette, i.e., 16th December 2020.
1.3. This Order shall apply to goods or articles of Phosphorus Oxychloride, but it shall not apply to such goods or articles meant exclusively for export.
 

2. Conformity to standard and compulsory use of Standard Mark

2.1. Goods or articles of Phosphorus Oxychloride shall conform to the Indian Standard IS 11657: 1986 as specified by the Bureau of Indian Standards.
2.2. Such goods or articles shall bear the Standard Mark under a valid licence from the Bureau of Indian Standards as per Scheme-I of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.
2.3. The requirement of the Standard Mark shall not apply to goods or articles manufactured exclusively for export, provided they comply with the specifications of the foreign buyer.
 

3. Certification and enforcement authority

The Bureau of Indian Standards (BIS) shall be the certifying and enforcing authority for goods or articles specified under this Order.

4. Penalties for contravention

Any person who contravenes the provisions of this Order shall be liable for penalties as provided under the Bureau of Indian Standards Act, 2016. 

This Order ensures the regulation of Phosphorus Oxychloride products in India, mandating quality standards while allowing exceptions for export purposes.
