BIS Quality Control Order for Insulated Flask for Domestic Use

Dear Viewer,
Important update regarding Indian Standard applicable to all existing Licence holders/ New applicants/ manufacturers/ importers/ product sellers for Insulated Flask for Domestic Use.
The Ministry of Commerce and Industry, through the Department for Promotion of Industry and Internal Trade (DPIIT), issued the Insulated Flask, Bottles, and Containers for Domestic Use (Quality Control) Order, 2023, to ensure conformity of specified goods to Indian Standards. To address compliance timelines, the Ministry subsequently issued the Insulated Flask, Bottles, and Containers for Domestic Use (Quality Control) Amendment Order, 2024.
1. Short Title and Commencement
This Order may be called the Insulated Flask, Bottles and Containers for Domestic Use (Quality Control) Order, 2023.
It shall come into force as follows:
- For Medium and Large Enterprises: Six months from this Order's publication date (14th January 2024).
- For Small Enterprises, as defined under the Micro, Small, and Medium Enterprises Development Act, 2006 (27 of 2006): Nine months from this Order's publication date (14th April 2024).
- For Micro Enterprises, as defined under the Micro, Small, and Medium Enterprises Development Act, 2006 (27 of 2006): Twelve months from this Order's publication date (16th July 2024).
2. Compulsory Use of Standard Mark
Goods or articles Insulated Flask for Domestic Use shall conform to the corresponding Indian Standard IS 17790:2022.
Such goods shall bear the Standard Mark (ISI Mark) under a license from the Bureau of Indian Standards (BIS), in accordance with Scheme-I of Schedule-II of the BIS (Conformity Assessment) Regulations, 2018.
Exceptions:
- This Order does not apply to goods or articles manufactured domestically for export purposes.
- Goods or articles manufactured domestically or imported before the date of commencement of this Order may be sold or displayed up to six months from the date of commencement of the Amendment Order, 2024, provided the manufacturer or importer submits a Chartered Accountant-certified declaration to the Bureau.
- Enterprises registered under the Udyam portal, with an investment in plant and machinery or equipment not exceeding ₹25 lakhs and turnover not exceeding ₹2 crores for the previous financial year, shall be exempted from the provisions of this Order.
3. Certification and Enforcement Authority
The Bureau of Indian Standards (BIS) shall be the certifying and enforcing authority for the goods or articles Insulated Flask for Domestic Use.
4. Penalty for Contravention
- Any person who contravenes the provisions of this Order shall be punished under the Bureau of Indian Standards Act, 2016 (11 of 2016).
