Electrical Appliance Fans QCO Overview

The Ministry of Commerce and Industry has issued the Electrical Appliance Fans (Quality Control) Order, 2023 through Gazette Notification S.O. 1124(E) dated 5th March 2024. This order will come into force 6 months from the date of publication of the notification in the Official Gazette.

As per this order, all electrical fans must meet the IS 302 (Part 2/ Sec 80): 2017. The product must have the BIS Standard Mark as per the marking requirements. Manufacturers must obtain the BIS Licence under Scheme-I of Schedule-II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.

Implementation Date Under QCO

Micro enterprises, as defined under clauses (h) and (m), respectively, of section 2 of the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), shall come into force after 12 months from the date of publication. For small enterprises, the order will come into force after 9 months from the date of publication.

Purpose of the QCO

The main purpose of the Electrical Appliance Fans (Quality Control) Order, 2023 ensures that the electrical fans meet the required quality and safety requirement. The QCO has been introduced to -

• Ensure compliance with IS 302 (Part 2/Sec 80): 2017
• Prevent the sale of substandard product
• Make the BIS Standard Mark mandatory
• Strengthen consumer confidence in BIS-certified products

Mandatory BIS Certification Requirement

As per this Quality Control Order, manufacturers of the electrical fan must ensure that their product complies with the IS 302 (Part 2/Sec 80): 2017. It is mandatory to obtain the BIS License from the Bureau of Indian Standards as per Scheme-1 of Schedule-II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.

In case of non-compliance, any person who violates the provisions of this Order may face penalties under the Bureau of Indian Standards Act, 2016.

Exemption Under This Order

The Electrical Appliance Fans QCO does not apply to electrical fans manufactured domestically for export.
